Kenneth J. Bireta, 54, of Knoxville, TN, was heading north on the highway when he ran off the left side of the roadway into the median, overturned several times, and entered the southbound lanes just before 11 p.m. Monday, April 1, Virginia State Police said.
Bireta's Toyota Highlander then collided with a 2019 Nissan Rogue heading south.
Bireta suffered serious but non-life-threatening injuries in the crash and was taken to Winchester Medical Center for treatment. He was wearing a seatbelt.
The driver of the Nissan, William F. Allison Jr., 60, of Martinsburg, WV., died at the scene of the crash due to his injuries. He was not wearing a seatbelt.
After being released from the hospital, Bireta was taken into custody and charged with one count of driving under the influence, and one count of possession of a schedule I/II drug. He was taken to the Northwest Regional Adult Detention Center, where he was held without bond.
